The short version
- Your scripts, recordings and videos are yours. We use them only to run Cue for you.
- Cue is a production tool, not a compliance approval. You and your firm review, approve and are responsible for what you publish.
- Recordings and videos are deleted automatically 60 days after they're created. Download what you need to keep, because Cue isn't an archive.
- Anything AI drafts is a starting point. Review it before you use it.
- If your firm has a signed agreement with us, that agreement governs.
About these terms
These Terms of Service ("Terms") are an agreement between you and Cue Studios LLC, a Massachusetts limited liability company ("Cue," "we" or "us"). They cover the website at cuestudio.ai and the Cue Studio app at app.cuestudio.ai (together, the "Services"). By creating an account or using the Services, you agree to these Terms. If you use Cue on behalf of a firm, you confirm that you're authorized to accept these Terms for it, and "you" includes the firm.
If your firm has signed a Master Services Agreement or another written agreement with us, that agreement governs your firm's use of Cue, and these Terms apply only to anything it doesn't cover. Our Privacy Policy explains how we handle personal information.
Your account
- You must be at least 18 and use Cue for business purposes.
- Keep your login details secure. You're responsible for activity under your account, and you should tell us promptly if you think someone has used it without permission.
- Each seat is for one named person and can't be shared. A firm can reassign a seat when someone leaves or changes role.
- Firm administrators can manage branding, disclosures, scripts and advisor access, and can switch off an advisor's access at any time.
Free trial, plans and payment
New accounts can try Cue free for 14 days. After the trial, the Team plan is billed monthly for each active seat at the price shown on our pricing page when you subscribe, and you can cancel anytime to stop future charges. Enterprise pricing is set in a separate order form. AI features such as AI Twin videos use add-on credits, priced separately.
Payments are handled by our payment processor, and we don't store full card numbers. Prices don't include taxes, which you're responsible for. Fees already paid aren't refundable except where the law requires otherwise. If a payment fails and isn't resolved, we may suspend paid features until it is. We'll give you reasonable notice before a price change applies to your plan.
Your content
You own your content: the scripts, documents, recordings, brand assets and disclosure language you put into Cue, and the videos, captions, transcripts and posts Cue produces from them ("Output").
You give us permission to host, store, process, transcode, display and transmit your content and Output only as needed to provide the Services to you and run the features you choose. That permission ends for an item when it's deleted, except for backup copies awaiting routine deletion and anything the law requires us to keep.
We won't use your content, or any advisor's likeness or voice, in our marketing, demos or sample libraries without your written permission.
You're responsible for having the rights and consents your content needs, including from anyone who appears or speaks in it, and for any client or third-party material you upload.
What not to put into Cue
Cue is built for marketing videos, not client records. Don't upload, type, say or show on camera:
- client account numbers, financial account details or holdings
- Social Security, passport or other government ID numbers
- health information
If this kind of information ends up in Cue, you're responsible for it.
Acceptable use
You agree not to:
- record, upload or publish anything unlawful, defamatory, harassing, hateful or infringing
- use an AI Twin or any other feature to impersonate someone, or to put words in the mouth of anyone who hasn't approved them
- submit anyone else's face or voice to create an AI Twin
- reverse engineer or scrape the Services, get around usage limits or access controls, or use the Services to build a competing product
- use the Services, Output or our content to train or evaluate an AI model
- upload malware or anything designed to disrupt the Services
- use the Services in breach of U.S. export or sanctions laws
AI features
Cue uses machine learning and third-party AI services for features such as script drafting, transcription, captions, filler-word removal, eye correction and AI Twin videos. AI output can be inaccurate or incomplete, and it may resemble output produced for others. Review and edit it before you use it.
Drafts, topics and suggestions are production drafts. They aren't investment, legal, tax or compliance advice, and they aren't compliance-approved language. We don't use your content or Output to train general-purpose or multi-customer AI models. Our AI FAQ has more detail.
AI Twin
An AI Twin is an AI avatar of an advisor, built from that advisor's own recordings. It's created only after the advisor records a consent video in the app. If the advisor uses Cue through a firm, the firm must first get the advisor's written consent and release.
Only an advisor may create their own AI Twin. Videos made with an AI Twin are your Output and should go through the same review as any other video. You and your firm decide whether and how to disclose that a video uses an AI Twin, under your policies and the law. We'll turn off an AI Twin and delete the likeness data behind it within a reasonable time after the advisor or their firm asks, or after the account ends.
Compliance is your firm's call
Cue includes tools that support your firm's review process, such as locked scripts, firm-configured disclosures and review records. They work on the settings and content you provide. Cue does not review content for regulatory compliance, does not approve anything for publication, and does not warrant that any video or feature satisfies the SEC Marketing Rule, FINRA rules, recordkeeping requirements or any other law.
You and your firm are responsible for deciding whether a video is an advertisement, for its accuracy and any required disclosures, for your own review and approval, and for anything you publish. Cue is not an investment adviser, broker-dealer, law firm or compliance consultant, and doesn't give legal, compliance, tax or investment advice.
Retention, downloads and deletion
Cue is a production tool, not an archive or a books-and-records system. Recordings and videos are deleted automatically 60 days after they're created, unless your firm's agreement sets a different period, and the app shows each video's deletion date. Deletion can't be undone. Download and keep anything you or your firm need to retain, for as long as your regulators require.
You can download your videos at no extra charge until they're deleted. When your account ends, you have 30 days to download content that's still within its retention period. Backup copies may remain until they're overwritten in our normal backup cycle.
Our Services
The Services, our software, templates and in-app guidance belong to us or our licensors. These Terms give you a limited, non-exclusive, non-transferable right to use them for your business while your account is active. The Cue Studio name and logo are our trademarks.
We may use aggregated, de-identified data that contains none of your content to run and improve Cue. If you send us feedback, we may use it without any obligation to you.
We may change the Services over time. We won't make a change that materially reduces the core features of your paid plan during your current billing period, except where it's needed for security, legal reasons or because a third-party service we rely on changes. Features labeled beta or early access are provided as they are and may change or be withdrawn.
Availability and warranties
We work to keep the Services available, but we don't promise they'll be uninterrupted or error-free, that every recording will capture or render successfully, or that Output will be accurate or suitable for publication. Recording depends on your camera, microphone, browser and network.
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, CUE IS NOT LIABLE FOR LOST PROFITS OR FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR RECORDINGS AND REGULATORY FINES OR PENALTIES, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE FEES YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $1,000 IF YOU USED THE SERVICES FREE OF CHARGE. Some places don't allow these limits, so they may not fully apply to you.
Indemnity
You'll defend and indemnify Cue against third-party claims arising from your content or Output or how you publish it, your breach of these Terms, any AI Twin or likeness data you submit, or any regulatory action or client claim about content you created or published with Cue.
Suspension and ending your account
You can stop using Cue and cancel anytime. We may suspend or end your access if you breach these Terms, don't pay, put the Services or other customers at risk, or where the law requires it. Except in an emergency, we'll give you notice and a chance to fix the problem first. Terms that by their nature should continue after your account ends, such as ownership, disclaimers, limits on liability and indemnity, will continue.
General
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. If a dispute comes up, we'll each try to resolve it informally first. Any dispute that isn't resolved will be heard in the state or federal courts in Boston, Massachusetts, and either of us may seek an injunction in any court with jurisdiction.
We may update these Terms. If a change is material, we'll give notice on this page or by email before it takes effect, and using the Services after that means you accept the updated Terms. You may not transfer these Terms without our consent, and we may transfer them as part of a merger, acquisition or sale of assets. If any part of these Terms can't be enforced, the rest stays in effect, and not enforcing a provision isn't a waiver of it. These Terms, any order form you sign with us and our Privacy Policy are the entire agreement between us about the Services.
